All photographs on this website are the copyright © of Ted Leeming. If you wish to reproduce the photos depicted you must firstly obtain a chargeable reproduction licence by contacting the author of the work, Ted Leeming, via the licences page.

If you do not obtain a reproduction licence in advance of use you cannot use the images for any form of print, advertising, brochures, editorial publications, multimedia or any visual presentations or any other use. In addition, you cannot sell, publish, license or otherwise distribute any of the photographs. You also cannot place copies of the images on electronic bulletin boards or web sites.

A full set of Terms and Conditions will be forwarded to you with any quote received for licensing or prints of the material contained within the site.

Terms and Conditions

Within the Terms and Conditions noted below Ted Leeming photography will be referred to as TLP and the visitor to the site, whether an individual or representing any organisation, company or other any commercial party will be referred to as the Client.

  1. These terms and conditions will not vary unless by prior consent and written agreement between TLP and the Client. In the absence of any other written agreement or amendments these terms and conditions (including any prices that may be identified at the time of payment) will apply.
  2. In the agreement the term image, photo or picture can refer to photography, digital image, print, transparency, negative, design or artwork or any item which may be offered for the purpose of display or reproduction in any form (be it in the whole or in part thereof) including print, copy, slide presentation, display, visual presentation in any format or any other form of reproduction in any form.
  3. All images are the exclusive copyright of TLP and are supplied on loan to the Client. No copyright is presumed to pass from TLP to the Client through the provision of any image.
  4. The images supplied are assumed to have been received in good condition unless the Client informs TLP in writing within 14 days of receipt identifying the nature of the problem.
  5. No permission to reproduce any of the images is assumed other than those identified in the written agreement (which may include the invoice, receipt or permission to reproduce statement on a document) between TLP and the Client which may be sent in paper, electronic or other format. Any such agreement will include the specific reference number/name or code for the image in question. Unauthorised reproduction shall incur to the Client a payment to TLP of �200 or double the reproduction fee for the form of reproduction undertaken, whichever is the greater.
  6. Any agreement between TLP and the Client does NOT include the ability to assign any part of the license or invoice to a third party.
  7. All invoices will be paid within 30 days of issue unless otherwise agreed in writing between TLP and the Client. For newspaper, periodical and broadcasting use only, if agreed in writing in advance, payment can be made by the end of the calendar month immediately following publication or use, or within 3 months of the issue of the invoice, whichever is the sooner. Any overdue payment may incur an overdue payment of 2% per month (or part of a month).
  8. Whilst TLP has taken reasonable care to correctly identify, caption and orientate the images no liability can be accepted for any loss or damage incurred by the Client or any third party caused by errors.
  9. The Client must satisfy themselves that all necessary rights, model releases or consents which may be required for reproduction have been obtained and that the use of any image is not libellous or unlawful. The Client will indemnify TLP in respect of any claims, damages, costs or expenses TLP incurs arising from the use of any image supplied to the Client.
  10. Images cannot be altered, cropped or manipulated by any means without the prior written permission of TLP.
  11. All reproduction of images should identify the author unless otherwise agreed in writing. Failure to do so may result in a payment by the Client to TLP equal to 50% of the agreed reproduction fee.
  12. The Client agrees to provide TLP, upon request, with a copy of the publication that includes the licensed image/s free of charge.
  13. The Client fully indemnifies TLP against any unauthorised reproduction of an image submitted to the Client by a third party as a result of any breach by the Client of these terms and conditions (including but not limited to the Client allowing an image or copy of an image to come into the possession of a party without the prior written permission of TLP).
  14. If there is any breach in the terms and conditions TLP and the Client, where both parties agree, shall try to settle any dispute through mediation.
  15. The Client will indemnify TLP in respect of any claims, damages, costs or expenses TLP incurs as a result of any breach of copyright or the terms and conditions.
  16. Any license will terminate immediately if the Client a) dies; b) enters into voluntary or compulsory liquidation; c) has a receiver appointed; or d) fails to perform any of the obligations identified in the terms and conditions. In the event of termination all rights granted will immediately revert to TLP and any further exploitation of the image shall constitute an infringement of copyright.
  17. These terms and conditions shall be governed by the laws of Scotland.
